These Terms and Conditions govern your use of oqmechanical.com and the services provided by Ortega Quality Mechanical, LLC, doing business as OQ Mechanical (“OQ Mechanical,” “OQ,” “we,” “us,” or “our”). By using our website, texting or calling us, requesting an estimate, or hiring us to perform work, you agree to these terms.
Read them along with our Privacy Policy, which explains how we handle your information.
1. Using This Website
You may use our website to learn about our services, request an estimate, schedule work, and contact us. You agree not to use the site to submit false information, send spam or automated submissions, attempt to gain unauthorized access to our systems, scrape content, or interfere with the site’s operation.
We may change, suspend, or discontinue any part of the site at any time without notice. We try to keep the site available and accurate, but we do not guarantee it will be uninterrupted or error-free.

Text, photographs, logos, graphics, and other content on oqmechanical.com are owned by OQ Mechanical or used with permission and are protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, or use our content or our name and logo for any other purpose without our written permission.

We work to keep service descriptions, equipment information, and pricing guidance on the site current, but content is provided for general information only. Descriptions of services, equipment, and typical costs are not offers or guarantees. Manufacturer specifications, rebate programs, and code requirements change. Nothing on this website is a substitute for an on-site evaluation by a licensed technician.
2. Text Message Program
Ortega Quality Mechanical, LLC (OQ) sends text message updates and responses to consumer customers about pricing and products offered at oqmechanical.com.
When you opt in to the service, we may send you a message to confirm your signup. Message and data rates may apply. Message frequency varies. Text “HELP” for help. Text “STOP” to cancel.
You can cancel this service at any time. Just text “STOP” to 505-980-8382. After you send the message “STOP” to us, we will reply to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time, and we will start sending you messages again.
If at any time you forget what keywords are supported, just text “HELP” to 505-980-8382. After you send the message “HELP” to us, we will respond with instructions on how to use our service and how to unsubscribe.

3. Estimates and Quotes
Prices shown on our website or given over the phone are estimates based on typical conditions. A binding price requires an on-site evaluation and a written estimate from us.
- Written estimates are valid for 30 days unless the estimate states otherwise. Equipment and material costs move, and we may need to reprice after that window.
- Estimates cover the scope described in them. Conditions we could not see before starting work — failed wiring, corroded or undersized supply lines, asbestos or other hazardous material, code violations from prior work, structural issues, hidden leaks or damage — are not included.
- If we find something outside the original scope, we will stop, explain what we found, and give you a revised price before continuing. You are not obligated to approve additional work.
- Diagnostic and service call fees, when they apply, are disclosed before we dispatch a technician.
4. Scheduling, Access, and Cancellations
Appointments are scheduled in arrival windows, not exact times. Emergency calls, weather, and job conditions can move a window. We will contact you if your appointment is running late or needs to be rescheduled.
- Site access. You agree to provide safe and reasonable access to the work area, including access to electrical panels, shutoffs, attics, crawlspaces, and mechanical rooms. Please secure pets and clear the work area before we arrive.
- Authority. By scheduling work you confirm you are the property owner or are authorized by the owner to approve the work and, where applicable, to permit work in a shared or common area.
- Cancellation. Please give us as much notice as you can. We ask for at least 24 hours’ notice on scheduled installations so we can reassign the crew.
- Missed appointments. If our technician arrives and cannot access the property or no authorized person is present, we may charge a trip fee for the visit.
- Special-order equipment. Equipment ordered specifically for your job may be non-returnable. If you cancel after we place the order, you may be responsible for restocking charges or the cost of the equipment.
5. Payment
- Payment is due on completion of the work unless your written estimate or agreement states different terms.
- Installations and larger projects may require a deposit before we order equipment or schedule the crew. Progress payments may be required on multi-phase or commercial work.
- We accept the payment methods listed on your invoice. Financing, when offered, is provided by a third-party lender under that lender’s own terms, and approval is between you and the lender.
- Past-due balances may accrue interest and collection costs to the extent allowed by New Mexico law. If we have to pursue collection, you may be responsible for reasonable costs of collection and attorney fees.
- We retain all rights available to us under New Mexico lien law for labor and materials furnished to a property.
- Quoted prices do not include applicable gross receipts tax, permit fees, or disposal fees unless the estimate says they are included.
6. Warranties
Our labor. We warrant our workmanship for the period stated on your invoice or written agreement. If our work fails within that period, we will return and correct it at no labor cost to you.
Equipment and parts. Equipment, parts, and materials carry the manufacturer’s warranty. We are not the manufacturer and do not extend or modify those warranties. We will help you file a manufacturer claim, but manufacturer warranty terms, registration requirements, and coverage decisions belong to the manufacturer.
Our workmanship warranty does not cover:
- Normal wear, failure to perform recommended maintenance, or missed filter changes
- Damage from misuse, abuse, accident, vandalism, pests, fire, flood, freeze, power surge, lightning, or other events outside our control
- Work performed, altered, or repaired by anyone other than OQ Mechanical or a party we authorize
- Pre-existing conditions in ductwork, wiring, gas lines, plumbing, drainage, insulation, or building structure that we did not install and were not hired to correct
- Systems that have been undersized, misapplied, or installed against our written recommendation at your direction
- Comfort or efficiency outcomes affected by building envelope, insulation, or duct conditions we did not modify
Unpaid invoices suspend warranty coverage until the balance is settled.
7. Licensing, Permits, and Code
OQ Mechanical is a licensed New Mexico mechanical contractor, license number 391708, and carries general liability and workers’ compensation insurance. Proof of licensing and insurance is available on request.
Where a jurisdiction requires a permit and inspection, we pull the permit and coordinate the inspection unless your agreement says otherwise. Permit and inspection fees are billed at cost unless your estimate includes them. We perform work to applicable New Mexico and local code as it exists on the date of the work. Bringing pre-existing, non-compliant conditions up to current code is separate work and is priced separately.
8. Emergency and After-Hours Service
We offer emergency and after-hours service. Emergency, evening, weekend, and holiday calls may be billed at a different rate than standard business hours, and that rate is disclosed before we dispatch. Response times depend on call volume, weather, crew availability, and travel distance within our service area, and we do not guarantee a specific arrival time on emergency calls unless we have agreed to one in writing.
9. Reviews, Photos, and Testimonials
We may photograph completed work for our records, for warranty documentation, and for use in our marketing. Photos are of the equipment and the work area, not of you or your household, and we do not publish addresses. Tell your technician if you would prefer we not use photos of your job and we will note it on the account.
If you post a review or testimonial about us on a public platform, we may quote or share it. Reviews on our website reflect the experience of individual customers and are not a promise of any particular result on your job.
10. Limitation of Liability
To the fullest extent allowed by New Mexico law:
- The website and its content are provided “as is,” without warranties of any kind beyond those expressly stated in these terms.
- We are not liable for indirect, incidental, special, or consequential damages, including lost income, lost business, spoiled food or inventory, secondary property damage, or the cost of temporary heating or cooling.
- Our total liability arising out of any job is limited to the amount you paid us for that job.
- We are not responsible for delays or failures caused by events outside our reasonable control, including supply chain disruption, manufacturer backorders, utility outages, severe weather, or labor shortages.
Nothing in these terms limits any liability that cannot be limited under New Mexico law, and nothing here waives your rights under the New Mexico Unfair Practices Act.
11. If Something Goes Wrong
If you are unhappy with work we performed, call us at 505-980-8382 or email [EMAIL ADDRESS] and give us the chance to make it right. Most problems get resolved with a return visit. We ask that you contact us before pursuing a formal claim so we can try to resolve it directly.
12. Governing Law
These terms are governed by the laws of the State of New Mexico, without regard to its conflict of law rules. Any dispute that cannot be resolved directly will be brought in the state or federal courts located in Bernalillo County, New Mexico, and both parties consent to that venue.
If any provision of these terms is found unenforceable, the rest remains in effect.
13. Changes to These Terms
We may update these terms as our business, our website, or the law changes. Updates take effect when posted, and we will change the “Last updated” date at the top. The terms in effect on the date of your signed estimate or work order govern that job. Continuing to use our website after an update means you accept the revised terms.
